What Cap Season Means

Most H-1B positions are subject to an annual numerical limit, and employers seeking to sponsor a new cap-subject worker must participate in an electronic registration process before filing a full petition. This registration period, commonly called cap season, opens for a limited window each year.

Registration Timing

Registration typically opens in early March, with a defined submission window. Missing this window generally means waiting for the next annual cycle, so employers benefit from tracking the announced dates closely and preparing candidate information in advance.

The Selection Process

When registrations exceed the available numerical slots, USCIS conducts a random electronic selection. Selection is not based on when a registration was submitted within the window, but employers should still register as early as practical to avoid last-minute technical issues.

After Selection

Employers whose registrations are selected receive a designated period to file a complete H-1B petition, including a Labor Condition Application and supporting evidence establishing the specialty occupation and the candidate's qualifications. This filing window is also time-limited.

Preparing Before the Window Opens

Employers benefit from confirming beneficiary details, identifying the correct filing entity, and beginning to assemble supporting documentation before registration opens, so that a selected registration can move quickly into a complete petition.

If Not Selected

Candidates and employers not selected in a given cycle may consider alternative categories, such as O-1 or E-2 status where the facts support them, or plan for the next annual cap cycle.
